Betterment Levy in Israel (Heitel Hashbacha): Not Mas Shevach
Heitel hashbacha is a municipal levy, not mas shevach. The default rate is half the planning-driven betterment. From 1 May 2022 a pinui-binui plan on residential land is a quarter. The owner pays it when rights are realized — a sale, a building permit, or first use. We invent no citywide typical shekel bill.
A municipal levy, not the Tax Authority’s capital-gains tax
English pages still mash betterment levy (היטל השבחה) into mas shevach. Heitel hashbacha is a municipal levy under the Third Schedule to the Planning and Building Law. It is not mas shevach, which is a Land Taxation Law tax paid to the Tax Authority. Third Schedule s.1 defines betterment (rise in land value from a planning event) (השבחה): A rise in the value of land caused by approval of a plan, the grant of a relief (hakala), or permission for a non-conforming use (shimush choreg). A relief (a permitted deviation from the plan) (הקלה) and a non-conforming use (שימוש חורג) are planning events. They are not a sale of the flat. The July 2026 citywide median asking ₪4,850,000 (≈ $1,310,811 / €1,212,500 / £1,021,053; n = 1,037 tracked active listings) is the stake that file is about. Implied size — that median divided by apartment-scale ₪/sqm (n = 987) — is 88 sqm (950 sqft). It is not the betterment and not the levy.
The owner pays; a long-term lessee may pay first
Section 2 names the payer. If land is bettered — whether because exploitation rights were enlarged or in another way — the owner pays the levy under this Schedule. If the land is held on a long-term lease (chakhira ledorot), the lessee pays the levy. A long-term lessee who paid may recover from the owner the difference between what they paid and what they would have paid if the levy had applied only to the betterment of the leasehold. The right to extend the lease is taken into account. A typical privately owned Tel Aviv apartment is not that lease. State Minhal leasehold is. A levy that follows approval of a plan applies only to land inside the plan's area or adjoining it. A contract can shift who writes the cheque. It does not rewrite who the committee bills. The closing-cost model still carries this line at ₪0 on a labelled typical resale — that is the no-planning-event illustration, not a census.
| Cell | What the Schedule prints | What it is not |
|---|---|---|
| Default rate (s.3) | 50% — one half of the betterment. | A percent of the asking price, or mas shevach’s 25%. |
| Pinui-binui rate (s.3A) | 25% of the betterment on residential land from May 1, 2022. | An 80% leftover, or TAMA 38’s own statute. |
| Payer (s.2) | The owner; a long-term lessee pays and may recover part. | A buyer-side tariff, or a US-style escrow holdback. |
| When (s.7) | No later than realization of rights. Advances are allowed. | A fixed days-to-keys clock. |
Realization is a sale, a permit, or first use
The levy falls due on realization of rights (מימוש זכויות). Third Schedule s.1 lists three events. First: Receiving a building or use permit under this Law that could not have been given but for the plan, relief, or non-conforming use that created the levy. Second: Starting actual use as first permitted by the plan that created the levy. Starting use under a s.145ה change-of-use approval is not realization. Third: Transferring the land or the long-term lease, in whole or in part, or granting a right in it that must be registered in the land registers, for consideration or without — except a transfer by operation of law, a gift to a relative, or a transfer under a judgment that divides land rights between spouses on separation (including to their children). A gift to a spouse, parent, grandparent, descendant, a spouse's descendant, a sibling, and their spouses. is out. A transfer by operation of law is out. A spouses-on-separation judgment is out. Registering land-register rights that the person already held in fact before 1 July 1981, as owner under the Property Tax and Compensation Fund Law, is not realization. Section 7: The levy shall be paid no later than the day the person liable realized a right in the land on which the levy falls. The person liable may pay advances on account of it before the betterment valuation is set. A person who realized only part of the rights pays a proportionate levy according to the measure of realization that is liable. Keys are still possession, not title. Title still finishes at Tabu.
Pinui-binui is a quarter, unless the city zoned otherwise
Section 3A is the cell English pages still print as 50% on every rebuild. Despite s.3, from the determining date the levy on residential land because a pinui-binui plan was approved is one quarter of the betterment. That date is May 1, 2022 (ל׳ בניסן התשפ״ב). A local authority may, until the determining date and again at each five-year mark after it, divide the whole of its area into zones and set the pinui-binui levy in a zone at one half, one quarter, or none, having regard among other things to land values, existing and expected dwelling density, and development needs. A zone shall not be smaller than 30 dunam. That floor is 30 dunam. The local authority shall publish notice of its intention to take that decision at least 30 days before taking it. The decision and the intention notice are published in Reshumot and in a newspaper. A determination applies to every pinui-binui plan filed with a planning institution from the determination until five years after the determining date (or after the later re-determination). This file does not republish a Tel Aviv-Yafo s.3A zone map. Check the live municipal decision. The vote that lets a cluster sign is two-thirds, three-fifths, and more than half the common property — a different statute. TAMA 38 is not that 25% cell.
A licensed appraiser values the betterment; Tabu will not register without a certificate
Section 4: The betterment is determined by a real-estate appraiser shortly after the plan is approved, the non-conforming use is permitted, or the relief is granted. That person is the reserved appraiser (shamaut), not the broker. The local committee may defer making that valuation after a plan is approved until rights in the bettered land are realized. If valuation was deferred until realization, any landowner may at any time demand that the local committee value those lands. The valuation shall then be made within 90 days of the demand. That clock is 90 days. Where several plans were approved one after another and no levy was paid after any of them, the betterment is the difference between the land's value shortly before the first plan and its value immediately after the last. The valuation is made as of the plan's commencement day, or the day the relief or non-conforming use was approved, treating the land as if sold on the open market. These cells are who values the betterment and when. They are not an official citywide appraiser fee. Section 10 then binds the registry. A transaction that is a realization of rights shall not be registered in the land registers unless the registrar is shown a certificate, signed by the chair of the local committee or a person they authorized, that every amount then due as levy on the land under this Schedule has been paid, or that security was given for all or part of it, as this Schedule requires. Registering a mortgage on the land does not require that certificate. 'Mortgage' has the meaning in Land Law s.4. A building permit shall not be issued, a relief shall not be granted, and a non-conforming use shall not be permitted, so long as the levy — or the part of it then due — has not been paid or secured as this Schedule requires.
Ask the committee in writing; do not invent a typical bill
Planning and Building Law s.119א is the buyer’s letter. A local planning committee shall give, in writing, to anyone interested in land, on that person's request, within thirty days, information about the plans that concern the land — whether they are in force, deposited, or a notice of their preparation has been published under s.77 — and about conditions under s.78 that apply to the land, if any were set. The committee shall also give information about liability to pay a betterment levy. The committee has 30 days. That letter sits in due diligence next to the permit file. It is not a valuation and not a ₪ invoice. Four cells stay unpublished. A citywide typical shekel levy — the tracked listing panel has no betterment field. A share of Tel Aviv sales that trigger it — a sale with no planning event has no betterment to tax; that is a legal if, not a census. A Tel Aviv s.3A zone map — This file does not republish a Tel Aviv-Yafo s.3A zone map. Check the live municipal decision. An official appraiser fee for the betterment valuation — These cells are who values the betterment and when. They are not an official citywide appraiser fee. Section 19 lists exemptions. Section 19(b) lists cases in which no levy is due. They include, among others, residential land in a government-declared rehabilitation neighbourhood while the declaration stands; certain education, culture, science, religion, charity, welfare, health, sport, or public-trust land used for those purposes; a Ministry of Construction and Housing assisted self-build or enlargement within the aid programme's area; accessibility service-area (including a lift that the law does not already require); and a protected space (mamad) up to the Civil Defence Law area, or a shelter-improved room of that area where a mamad cannot be built. Those are Act-text exemption cells. They are not a Tel Aviv parcel map and not a finding that a typical tracked listing is exempt. A hardship carve-out on a relief or a non-conforming use is discretionary: Where the levy fell on a landowner because a relief or a non-conforming use was granted, the local committee may exempt that owner from all or part of it because of their material situation.
Frequently asked questions
What is heitel hashbacha (Israeli betterment levy)?
betterment levy (היטל השבחה) is a municipal levy on betterment (rise in land value from a planning event) (השבחה). Third Schedule s.1: A rise in the value of land caused by approval of a plan, the grant of a relief (hakala), or permission for a non-conforming use (shimush choreg). It is not mas shevach.
Is the betterment levy the same as capital-gains tax (mas shevach)?
No. Heitel hashbacha is a municipal levy under the Third Schedule to the Planning and Building Law. It is not mas shevach, which is a Land Taxation Law tax paid to the Tax Authority. Mas shevach on an individual’s real gain is 25% under the Land Taxation Law. This levy is half the betterment (s.3), or a quarter on residential land after a pinui-binui plan from May 1, 2022.
Who pays heitel hashbacha — buyer or seller?
Section 2: If land is bettered — whether because exploitation rights were enlarged or in another way — the owner pays the levy under this Schedule. If the land is held on a long-term lease (chakhira ledorot), the lessee pays the levy. A typical apartment sale is paid by the owner who is selling. Contracts can reallocate the cheque; they do not rewrite the statute.
When is the betterment levy due?
Section 7: The levy shall be paid no later than the day the person liable realized a right in the land on which the levy falls. The person liable may pay advances on account of it before the betterment valuation is set. Realization is a building permit that the plan made possible, first actual use, or a transfer — including an ordinary sale.
What is the pinui-binui betterment rate?
From May 1, 2022, Third Schedule s.3A sets 25% (one quarter of the betterment) on residential land where the betterment arises from approval of a pinui-binui plan. The default cell is still 50%. A local authority may zone areas of at least 30 dunam at one half, one quarter, or none.
Will Tabu register my purchase if the levy is unpaid?
Section 10: A transaction that is a realization of rights shall not be registered in the land registers unless the registrar is shown a certificate, signed by the chair of the local committee or a person they authorized, that every amount then due as levy on the land under this Schedule has been paid, or that security was given for all or part of it, as this Schedule requires. Registering a mortgage on the land does not require that certificate. 'Mortgage' has the meaning in Land Law s.4.
How do I find out if a Tel Aviv flat has a betterment-levy liability?
Planning and Building Law s.119א: A local planning committee shall give, in writing, to anyone interested in land, on that person's request, within thirty days, information about the plans that concern the land — whether they are in force, deposited, or a notice of their preparation has been published under s.77 — and about conditions under s.78 that apply to the land, if any were set. The committee shall also give information about liability to pay a betterment levy. That letter is due-diligence, not a valuation.
How much is the typical betterment levy on a Tel Aviv apartment?
We do not publish a citywide typical shekel bill. The levy is 50% — or 25% on a pinui-binui residential plan — of a licensed appraiser’s betterment, not of the asking price. The July 2026 citywide median asking ₪4,850,000 is the stake the file protects, not the levy.
Where this fits
This page is the betterment-levy citation target. The other charge on a sale is mas shevach. The 25% pinui-binui cell meets the 2006 encouragement law. The 30-day planning-info letter is due diligence. The registrar certificate is Tabu. The person who values the betterment is the licensed appraiser. The ₪0 typical-resale illustration remains on lawyers, fees and costs. The cluster map is the foreign-buyer guide. Hebrew terms are in the glossary.
