Short-Term Rental / Airbnb in Tel Aviv: A Tabu Purchase Is Not a License

A Tabu purchase of a typical Tel Aviv apartment is not a short-term rental license. The national lodging-license cell for vacation units with services starts above four units. Hotel, pension and hostel are a different licensed-business cell. Nightly letting is taxed as business income. We invent no citywide Airbnb ban.

A Tabu extract is title, not a lodging license

A Tabu purchase of a typical Tel Aviv residential apartment is not a short-term rental license. The national lodging-license cell for vacation units with services starts above four units. Hotel, pension and hostel are a different licensed-business cell. Nightly letting is taxed as business income. We invent no citywide Airbnb ban and no citywide short-term share. English pages that paste “Airbnb is banned in Tel Aviv” or “every buyer can list tonight” onto a residential file are mixing cells. The July 2026 citywide median asking ₪4,850,000 (≈ $1,310,811 / €1,212,500 / £1,021,053; n = 1,037 tracked active listings) is the stake that slogan would sit on. Implied size — that median divided by apartment-scale ₪/sqm (n = 987) — is 88 sqm (950 sqft). It is not a short-term invoice. Tracked listings are not holdings. Title still finishes at Tabu. Official 2026 registrar cells stay the certified extract ₪88 and the warning-note register cell ₪188. Neither paper is a business license — the Licensing of Businesses Law paper for a listed business, not a Tabu extract and not an occupancy certificate. (רישיון עסק).

The national lodging-license cells that do exist

The Interior Minister may designate, by order, businesses that require a license, and define them, in order to secure listed purposes or some of them. One listed purpose is fulfilling the purposes of the planning and building laws (s.1(a)(6)). Other listed purposes include environmental quality, public safety, safety of people on the premises, public health, and fire-service laws. A person shall not engage in a license-required business unless they hold a license, a temporary permit, or an expedited permit under this law and in accordance with its conditions. For a business that is not mobile, a person shall not engage in it unless that paper describes the premises where they engage. Inside a local-authority area the licensing authority is the head of the local authority or a person they authorized — the local licensing authority. The businesses listed in the Schedule are license-required businesses. A business listed in the Schedule also requires a license for the purpose of fulfilling the purposes of the planning and building laws. The numbered lodging cells sit in group 7.1 (lodging and overnight stay): hotel — grouped in the Order and in the Law's First Schedule with a pension and a hostel, not with a typical one-apartment residential let. (בית מלון), pension and hostel in item 7.1א; and lodging units — the 2013 Order's vacation-rental cell, which also requires services to the renters and more than four units. (יחידות אירוח) in item 7.1ב. Renting lodging units for vacation purposes, accompanied by providing services to the renters, when the number of lodging units intended for rental exceeds four. A typical one-apartment nightly let is not that printed cell. The cell is vacation purpose plus services plus more than four units. We invent no citywide rule that one unit is therefore always unlicensed or always legal. Confirm the paper you actually hold with a licensed Israeli lawyer.

Numbered lodging-license cells already on disk. None is a Tabu purchase, and none is a citywide Airbnb ban.

Licensing of Businesses Law, 5728-1968 s.4 A person shall not engage in a license-required business unless they hold a license, a temporary permit, or an expedited permit under this law and in accordance with its conditions. For a business that is not mobile, a person shall not engage in it unless that paper describes the premises where they engage. A Tabu extract or an occupancy certificate.
Licensing of Businesses Law, 5728-1968 First Schedule item 3 Hotel, pension, hostel — provided they are not intended mainly to give lodging and overnight services to minors. A typical one-apartment residential let.
Licensing of Businesses (Businesses Requiring a License) Order, 5773-2013 item 7.1א Hotel, pension, hostel and the like. Every nightly listing on a privately owned flat.
Licensing of Businesses (Businesses Requiring a License) Order, 5773-2013 item 7.1ב Renting lodging units for vacation purposes, accompanied by providing services to the renters, when the number of lodging units intended for rental exceeds four. A printed nights-per-year clock, or a one-unit default.
Planning and Building Law, 5725-1965 s.145(a) A person shall not do, or begin to do, any of the listed acts except after the local licensing authority has given a permit, and shall do it only in accordance with the permit's conditions. The listed acts include any other work or use that regulations have made permit-required. A change-of-use permit hiding inside the sale contract.

Planning use and house rules are separate cells

A person shall not do, or begin to do, any of the listed acts except after the local licensing authority has given a permit, and shall do it only in accordance with the permit's conditions. The listed acts include any other work or use that regulations have made permit-required. That due-diligence cell already lives on disk. A teudat gmar is a first-connection approving-authority certificate, not a lodging license. A typical second-hand flat already on the grid is not that first-connection cell. Registered house rules, and any registered change, also bind a person who becomes an apartment owner afterwards. A decision of the apartment owners adopted under the house rules and entered in the decision book binds every apartment owner, whether they already owned at the time or became an owner afterwards. Those va’ad bayit cells bind a later buyer whether or not a platform listing is already live. Read the תקנון and the decision book before treating nightly guests as a default use of a dwelling apartment. We invent no citywide house-rule census.

Nightly letting is taxed as business income

The Israel Tax Authority treats short-term residential letting as business income. The monthly exemption track and the flat 10% track are written to exclude business income. That cell already lives on the rental-income page. It is not a lodging license and not a yield premium. The 2.8% citywide gross yield in July 2026 is ordinary asking rent (n = 1,529) against ordinary asking sale (n = 1,037). Citywide median asking rent is ₪10,500 a month (≈ $2,838 / €2,625 / £2,211). Citywide gross yield is ordinary asking rent against ordinary asking sale. It is not a short-term yield. Price a holiday-let model on the ordinary ladder, not on the exemption or the flat track. Those advertised rents are ordinary lets — a typical listing is not a protected tenancy. The investment page already refused to invent a net yield. This page refuses to invent a short-term premium on the same sticker.

What numbers stay unpublished

A citywide Airbnb ban — We fetched no Tel Aviv municipal bylaw that prints a citywide Airbnb ban, and we do not invent one. A citywide short-term share — The asking-rent panel has no short-term flag. We invent no citywide share. A nights-per-year clock — The Order prints a unit-count threshold, not a nights-per-year clock. A municipal short-term shekel fee — These statutes set when a license is required, not a Tel Aviv shekel tariff. A typical short-term yield — Citywide gross yield is ordinary asking rent against ordinary asking sale. It is not a short-term yield. Official 2026 Tabu cells stay the extract ₪88 and the warning note ₪188. The cluster map is the foreign-buyer guide.

Frequently asked questions

Does buying a Tel Aviv apartment give me the right to list it on Airbnb?

No. This is not legal advice.

Is short-term rental banned in Tel Aviv?

We fetched no Tel Aviv municipal bylaw that prints a citywide Airbnb ban, and we do not invent one. A person shall not engage in a license-required business unless they hold a license, a temporary permit, or an expedited permit under this law and in accordance with its conditions. For a business that is not mobile, a person shall not engage in it unless that paper describes the premises where they engage. The printed national lodging cells are hotel / pension / hostel, and vacation units with services above 4. Confirm the planning use and the house rules on the file you actually buy.

How many apartments trigger a lodging-business license?

Renting lodging units for vacation purposes, accompanied by providing services to the renters, when the number of lodging units intended for rental exceeds four. A typical one-apartment nightly let is not that printed cell. The cell is vacation purpose plus services plus more than four units. We invent no citywide rule that one unit is therefore always unlicensed or always legal.

Is a hotel license the same cell as a one-bedroom nightly let?

No. Hotel, pension, hostel and the like. The Law's First Schedule item 3 prints the same hotel / pension / hostel group. A typical privately owned Tabu flat is not that paper.

Do I pay the ordinary rental-income tracks on a holiday let?

The Israel Tax Authority treats short-term residential letting as business income. The monthly exemption track and the flat 10% track are written to exclude business income. That cell already lives on the rental-income page. It is not a lodging license and not a yield premium.

Can the building committee stop short-term guests?

Registered house rules, and any registered change, also bind a person who becomes an apartment owner afterwards. A decision of the apartment owners adopted under the house rules and entered in the decision book binds every apartment owner, whether they already owned at the time or became an owner afterwards. Read the תקנון and the decision book before treating nightly letting as a default.

What is the official Tel Aviv short-term rental fee?

These statutes set when a license is required, not a Tel Aviv shekel tariff. Official 2026 Tabu cells on the purchase file stay the certified extract ₪88 and the warning-note register cell ₪188.
