Protected Tenant in Israel: A Typical Asking-Rent Listing Is Not One
A typical Tel Aviv asking-rent listing is not a protected tenancy. The 1972 Tenants Protection Law does not apply to a property that was vacant on 20 August 1968, or vacated after that date, unless it was later let with key money. An ordinary 1971 lease ends at the agreed term. We invent no citywide protected-tenant share.
New tracked listings this week are on the weekly page (neighborhood / rooms / price-size bands). The Monday sample with exact asking prices is on the subscribe page.
Two lease cells, not one Israeli-tenant slogan
A typical Tel Aviv asking-rent listing is not a protected tenancy. The 1972 Tenants Protection Law does not apply to a property that on 20 August 1968 had no tenant entitled to hold it, or that was vacated after that date, unless it was later let with key money. A building completed after that date and let after that date is outside the law. An ordinary 1971 lease ends at the agreed term. Buying with a sitting tenant is not the same cell as buying with a protected tenant. English pages that paste a lifetime lock onto every Tel Aviv tenant are mixing those cells. protected tenant — a tenant who holds under the 1972 Tenants Protection Law, not under a typical 2026 asking-rent listing. (דייר מוגן) is the 1972 class. The July 2026 citywide median asking rent is ₪10,500 a month (≈ $2,838 / €2,625 / £2,211; n = 1,529 tracked rental listings). Citywide gross yield on that panel against the asking-sale panel is 2.8% (n asking = 1,037). Those figures are advertised ordinary lets. The panel has no protected-tenant field. Tracked listings are not holdings. The due-diligence page already said the lawyer reads the extract. This page is the occupancy citation target.
The 1972 law is a closed class after 20 August 1968
Tenants Protection Law [Consolidated Version], 5732-1972 (consolidated commencement 1972-10-09) s.2: This law applies to a lease of a building or part of a building, and of a yard or garden that serves the purpose of the lease. The door that closes most 2026 files is the vacant-property pair. A property that on 20 August 1968 had no tenant entitled to hold it — this law does not apply to its lease so long as it was not let with key money. That is s.9 (נכס פנוי). A property vacated after 20 August 1968 of every tenant entitled to hold it — whether by a court eviction judgment or lawfully for another reason — this law does not apply to its lease so long as it was not let with key money. The same applies if the landlord themselves held immediately before it was vacated. That is s.10. A property in a building whose construction was completed after 20 August 1968, and that was let after that date — this law does not apply to its lease. That is s.14. The date those three cells share is 26 Av 5728 (20 August 1968). A typical privately owned Tel Aviv resale on the July 2026 asking panel is not that leftover class unless a lawyer finds a 1972 cell that still attaches.

Hold-over is the 1972 cell English pages mash onto every tenant
A tenant who holds after the lease term has ended stays on the terms that were agreed at the end of that term, or as last changed by agreement or by law. They may not sub-let the whole property except with the landlord's consent. That is s.19 of the 1972 law — the sentence that reads like “they stay after the term.” It applies only where this law still applies. The ordinary 1971 cell is the opposite shape. A lease is a right granted for consideration (rent) to hold and use property, not forever. If no term was agreed, or the parties continued after the agreed term without setting a new term, either party may end the lease by giving the other reasonable prior notice. At the end of the lease term the tenant returns the property to the landlord vacant of every person or thing, except the landlord's property that serves the let property. The landlord then takes it back. Confirm which paper is on the file with a licensed Israeli lawyer before treating a sitting occupant as a 1972 lock. The July 2026 citywide median asking ₪4,850,000 (≈ $1,310,811 / €1,212,500 / £1,021,053; n = 1,037 tracked active listings) is the stake that slogan would sit on. Implied size — that median divided by apartment-scale ₪/sqm (n = 987) — is 88 sqm (950 sqft). It is not a key-money invoice.
Key money is a 1972 consideration, not a 2017 deposit
Dmei mafteah — any consideration that is not rent, given in connection with a lease of the let property, or with taking or returning possession under this law, whenever it was paid. key money — any consideration that is not rent, given in connection with a lease or with taking or returning possession under the 1972 law, whenever it was paid. (דמי מפתח). An outgoing tenant is entitled to a share of the key money given, or that may be given, by or for the proposed incoming tenant. An outgoing tenant who began to hold after 14 August 1958 takes 85% of key money if they held not more than one year; 75% if more than one year but not more than two; 66⅔% if more than two years but not more than five; 60% if more than five years. Those percentages are the Act-text split of key money when the 1972 law still applies and key money is actually being paid. They are not a 2026 typical shekel bill and not a deposit on an ordinary asking-rent listing. The 2017 residential chapter prints a different word: security for the tenant's duties under a residential lease — the 2017 Rent and Loan Law cell, not key money. (ערובה). If the landlord asks the tenant for one or more securities that cost the tenant money, including a bank guarantee or cash, their combined amount shall not exceed the lower of (a) the rent the tenant undertook for one third of the lease term and (b) three months of the monthly rent the tenant undertook. The landlord may realise a security only for unpaid rent, defects the tenant must repair, unpaid running charges the tenant owes, or failure to vacate at the end of the term, in the amounts the section lists. After the term ends the landlord returns the security or its remainder, including fruits, within 60 days of the apartment being returned or of the tenant's listed debts being paid, whichever is later. On the July 2026 citywide median asking rent, three months is ₪31,500 (≈ $8,514 / €7,875 / £6,632) — labelled illustration when that three-month cell is the lower cap, not a typical deposit and not key money. Route the paper through the title file.
Eviction of a protected tenant is listed grounds plus a judgment
Despite any contract, and without derogating from another enactment, these alone are the eviction grounds: unpaid rent; a lease term whose breach gives the landlord a right to claim eviction; considerable damage by the tenant's wilful act; habitual illegal use (a missing licence is not, by itself, illegal use); habitual harassment of neighbours, including a landlord who is a neighbour; a sub-lease that extracts an unfair profit; the property is needed for the landlord themselves and the landlord has given written notice of willingness to put alternative accommodation at the tenant's disposal (a business property only if needed for the landlord's livelihood); the state or a local authority needs it for an essential public purpose, with the same written alternative-accommodation notice; an approved public body needs it to let to people of limited means after the original conditions ceased, with the same notice; the landlord wants to demolish or substantially alter or repair and has the required building licence, with the same notice; a yard or garden is needed to build, with a building licence and the same notice. Even when a ground exists, the court may refuse an eviction judgment if it is not just in the circumstances. A court that gives an eviction judgment may grant the tenant an extension of not more than one year if it finds that extension just. The judgment is not executed before that extension ends. Despite any Ottoman legislation, a let property is not evicted except on a court judgment. The 1972 law prints listed grounds, a justice filter, and a maximum one-year extension. It does not print a 90-day eviction clock. Buying the building is not, by itself, a printed 1972 ground. Official 2026 Tabu cells on the purchase file stay the certified extract ₪88 and the warning-note register cell ₪188 — registrar tariffs, not an eviction fee. Title still finishes at Tabu. We invent no citywide share of Tel Aviv stock that still sits in this class, and we name no cases that fill in “just” on s.132.
Buying with a sitting tenant is a notice cell, not a 1972 lock
A landlord who granted their rights in the let apartment to another under the land-transfer rule shall notify the tenant in writing before the date they must hand the apartment to the buyer, with the buyer's particulars and how to contact them. That is Rent and Loan Law, 5731-1971 s.25יא — the 2017 residential chapter. The Act-text starting cell is ₪20,000 a month. It updates on 1 January each year by the CBS consumer-price index and is rounded to the nearest ₪10. We do not republish a 2026 Rishumot notice figure we have not fetched. Citywide median asking rent ₪10,500 sits below the Act-text starting cell ₪20,000. The 2017 residential chapter also does not apply to a hotel or holiday let, a hostel, protected housing, student or worker dorms, a lease of three months or less with no extension option, a lease longer than ten years with no earlier landlord cancellation option, or a lease between relatives as defined there. An ordinary sitting tenant is a fact for the process and the handover date. It is not automatic 1972 protection. A handover still puts the buyer in possession only of what the contract delivers. Confirm the occupant’s paper before treating keys as vacant possession.
Capital gains already names one protected-tenancy leftover
A second apartment is ignored for the only-apartment exemption if it is let under protected tenancy predating 1 January 1997 (among other listed cases). The capital-gains page already prints that 1 January 1997 cutoff as one of the s.49C deemed-single cases. It is a seller-side tax cell, not a census of our rent panel and not a reason to treat the 2.8% gross yield as a protected-tenant yield. The rental-income tax tracks sit on ordinary asking rent. We invent no citywide share of second apartments that still meet that 1997 protected-let test.
What numbers stay unpublished
A citywide protected-tenant share — no panel field. A typical 2026 key-money shekel bill — Those percentages are the Act-text split of key money when the 1972 law still applies and key money is actually being paid. They are not a 2026 typical shekel bill and not a deposit on an ordinary asking-rent listing. A 90-day eviction clock — The 1972 law prints listed grounds, a justice filter, and a maximum one-year extension. It does not print a 90-day eviction clock. The indexed 2026 high-rent notice amount — The Act-text starting cell is ₪20,000 a month. It updates on 1 January each year by the CBS consumer-price index and is rounded to the nearest ₪10. We do not republish a 2026 Rishumot notice figure we have not fetched. Named court cases that fill in “just” or “reasonable notice.” Official 2026 Tabu cells stay the extract ₪88 and the warning note ₪188. The cluster map is the foreign-buyer guide.
Frequently asked questions
Is every Israeli tenant a protected tenant?
No. This is not legal advice.
What is dmei mafteah (key money)?
key money — any consideration that is not rent, given in connection with a lease or with taking or returning possession under the 1972 law, whenever it was paid. Dmei mafteah — any consideration that is not rent, given in connection with a lease of the let property, or with taking or returning possession under this law, whenever it was paid. It is not the 2017 security for the tenant's duties under a residential lease — the 2017 Rent and Loan Law cell, not key money. (ערובה).
Can I evict a protected tenant in 90 days if I buy the flat?
The 1972 law does not print a 90-day clock. Despite any Ottoman legislation, a let property is not evicted except on a court judgment. The 1972 law prints listed grounds, a justice filter, and a maximum one-year extension. It does not print a 90-day eviction clock.
If I buy with a sitting tenant, do they become protected?
Not by the purchase. A landlord who granted their rights in the let apartment to another under the land-transfer rule shall notify the tenant in writing before the date they must hand the apartment to the buyer, with the buyer's particulars and how to contact them. That is notice on an ordinary lease, not a 1972 lock. A lawyer reads whether a 1972 cell still attaches.
How much key money is typical in Tel Aviv in 2026?
There is no typical shekel bill on this disk. Those percentages are the Act-text split of key money when the 1972 law still applies and key money is actually being paid. They are not a 2026 typical shekel bill and not a deposit on an ordinary asking-rent listing. We invent no citywide protected-tenant share.
What is the official security cap on an ordinary residential lease?
On the July 2026 citywide median asking rent that three-month cell is ₪31,500 — labelled illustration, not a typical deposit.
Does a protected tenancy change capital-gains tax?
A second apartment is ignored for the only-apartment exemption if it is let under protected tenancy predating 1 January 1997 (among other listed cases). That is Income Tax Ordinance s.49C, already on the capital-gains page. It is not a citywide share of our asking panel.
Is the 2.77% gross yield a protected-tenant yield?
No. Citywide gross yield is 2.8% from two July 2026 asking panels (n rent = 1,529 / n asking = 1,037). Those rents are advertised ordinary lets. The panel has no protected-tenant field.
Where this fits
This page is the protected-tenant / sitting-occupant citation target. The lawyer’s file is due diligence. Keys versus title is handover versus Tabu. Ordinary asking rent is Tel Aviv rent prices and rental yield. The sale-side leftover is capital gains. Hebrew terms are in the glossary. Return to the buying-guide hub.
