Escrow and Trust Accounts in Israel: No Third-Party Escrow Industry
Israel has no third-party escrow industry as standard. The stack is the lawyer’s trust account and a Land Law section 126 warning note. Ethics rule 39 requires a separate bank account for funds held in trust. Sale Law defaults to pay-on-delivery. The official 2026 warning-note cell is ₪188. We invent no escrow premium.

There is no escrow industry
Israel has no third-party escrow industry as standard and no statute that creates a title-insurance company on a privately owned apartment file. Chamber of Advocates (Professional Ethics) Rules 5746-1986 rule 39 requires an advocate to maintain a separate bank account for funds deposited with the advocate in trust. Land Law s.126 records a written undertaking as a warning note; s.127 blocks a conflicting later registration until that note is deleted. Sale Law defaults to concurrent delivery and payment. Those three cells are not an escrow company. English pages that sell a US closing table on a Tel Aviv file are mixing three statute cells. The July 2026 citywide median asking ₪4,850,000 (≈ $1,310,811 / €1,212,500 / £1,021,053; n = 1,037 tracked active listings) is the stake those cells sit on. Implied size — that median divided by apartment-scale ₪/sqm (n = 987) — is 88 sqm (950 sqft). It is not an escrow invoice. Tracked listings are not holdings. The purchase contract page holds the pay-on-delivery defaults. The Tabu page holds the warning-note tariff. This page is the escrow citation target.
Ethics rule 39 is the trust-account cell
Chamber of Advocates (Professional Ethics) Rules, 5746-1986 (Kovetz HaTakanot 5746, 1373) rule 39 is one sentence: An advocate shall maintain a separate bank account for funds deposited with the advocate in trust. The market English is lawyer's trust account — the usual receiving account for a non-resident purchase. Israel has no third-party escrow industry as standard. (חשבון נאמנות). The Act-text name on the ethics file is separate trust / deposit bank account that Chamber ethics rule 39 requires an advocate to maintain for funds deposited in trust. (חשבון פקדון). That is a Chamber duty on the advocate who holds the money, not a Justice-Ministry escrow licence and not a title company. A buyer acting in person is not required by statute to hire a lawyer; Chamber Law s.20 reserves the paid Tabu and drafting acts done for another. A remote close still uses this account. The funds page is the AML gate into it. We invent no citywide lawyer bill for holding the account.
| Cell | What the source prints | What it is not |
|---|---|---|
| Chamber of Advocates (Professional Ethics) Rules, 5746-1986 rule 39 | An advocate shall maintain a separate bank account for funds deposited with the advocate in trust. | A Justice-Ministry escrow licence or a title company. |
| Land Law, 5729-1969 s.126–127 | So long as the note has not been deleted, a conflicting transaction shall not be registered except with the entitled person's consent or by court order. | Completed ownership. Land Law s.7 still finishes the sale only at registration. |
| Sale Law, 5728-1968 s.23 | The seller's duty to deliver the sold asset and the buyer's duty to pay its price are concurrent obligations that must be performed together. | A staged US escrow table or an official second-hand deposit percent. |
| Sale of Apartments (Assurance of Investments of Persons Acquiring Apartments) Law, 5735-1974 s.2 | A defined builder-seller may not take more than 7% of the price unless a listed security is given. | A typical private resale tariff or an escrow premium. |
The warning note is the lock, not an escrow company
If the registrar is satisfied that an owner of land, or the holder of a lease, loan-for-use, easement, right of first refusal or mortgage, undertook in writing to do a transaction in it or to refrain from doing one, the registrar shall, on the application of the person who undertook or of the person entitled under the undertaking, register a note of that. It does not matter whether the undertaking was in an agreement, an irrevocable power, or another document, or whether it was express or implied, absolute or conditional. That is warning note / caution on the land register — Land Law s.126. It is a Tabu lock, not an escrow company. (הערת אזהרה) under Land Law, 5729-1969 s.126. So long as the note has not been deleted, a conflicting transaction shall not be registered except with the entitled person's consent or by court order. Official 2026 register cell ₪188 (≈ $51 / €47 / £40; item 13(a)(1)); deletion is ₪127 (item 13(b)); the certified extract is ₪88. Those are registrar tariffs, not an escrow premium and not a percent of the July 2026 median asking ₪4,850,000. A warning note is not a completed transfer. Section 7 still finishes the deal only at registration. The process page files the note after signing. A later registered buyer is still Land Law s.9, a Tabu priority race, not a US title policy.
Sale Law is pay-on-delivery, not staged escrow
The seller must deliver the sold asset to the buyer and transfer ownership of it to the buyer. The buyer must pay the seller the price and accept the sold asset. The price is paid at the time the sold asset is delivered, at the seller's place of business, or if the seller has none, at the seller's permanent residence. The seller's duty to deliver the sold asset and the buyer's duty to pay its price are concurrent obligations that must be performed together. Those are Sale Law, 5728-1968 ss.7, 19, 21 and 23. The default is concurrent delivery and payment, not a title-company closing table. Delivery is placing the flat at the buyer’s disposal (s.8) — possession, on the handover page. A land transaction requires registration; the transaction is completed by registration. A transaction that was not completed by registration is treated as an undertaking to do a transaction. There is still no official second-hand deposit percent on this disk. Practice stages money through the trust account against the contract. That practice is not a published 10% or 15% cell. Our tracked days-on-market median is 33 days from first publication to detected removal (p25–p75 16–42; n = 94; 59.1% dated coverage). That metric is time-on-listing. It is not an escrow clock.
The 1974 7% cell is not escrow
A seller shall not receive from a buyer, on account of the flat's price, a sum exceeding 7 percent of the price unless the seller has done one of the listed acts — despite anything in the sale contract. The first listed act is delivering a bank guarantee for the return of every shekel the buyer paid (except the VAT component) if the seller cannot transfer the agreed ownership or other right because of an attachment, a stay, a winding-up or receiver order, or circumstances that create an absolute bar to delivering possession. Cancelling the sale contract by itself is not that absolute bar. The other listed acts include an approved insurer's policy naming the buyer as beneficiary; a first mortgage of the flat or a relative share of the land in the buyer's (or an approved trustee's) favour; a Land Law s.126 warning note on the sale, provided no prior charge, attachment or third-party right ranks ahead of it; or transferring the agreed ownership or other right, clean of charges. The 7% unsecured-payment ceiling and the listed securities bind that defined seller, not a typical second-hand private owner selling the home they live in. On the July 2026 citywide median asking ₪4,850,000 (n = 1,037) that if line is ₪339,500 (≈ $91,757 / €84,875 / £71,474). Labelled illustration, not a typical resale invoice and not an escrow premium. One of the listed securities is a clean Land Law s.126 warning note. That is how the 1974 builder-seller stack meets the Tabu lock — still not a third-party escrow company. A typical private second-hand sale of a residential apartment is none of those builder cells.
What our panel can say without inventing an escrow bill
We will not invent a citywide escrow premium. The numbered neighbour on a Tel Aviv file is the official 2026 warning-note ₪188. A cross-border transfer of ₪1,000,000 or more is an automatic bank report under the 2001 Banking Corporations Order already published on transferring funds. On the July 2026 hood-panel median ticket a non-resident cash-to-close is ₪2,894,200 (≈ $782,216 / €723,550 / £609,305) — 2.9× that threshold. The report is threshold, not suspicion. The stake remains the citywide median asking ₪4,850,000. Tracked listings are not holdings.
What numbers stay unpublished
An escrow-company licence or premium — Israel has no third-party escrow industry as standard and no statute that creates a title-insurance company on a privately owned apartment file. A title-insurance tariff — this file prints none. An official second-hand deposit percent — Sale Law defaults to pay-on-delivery; our listing panel has no contract-deposit field. A citywide lawyer bill for holding the trust account — ethics rule 39 is a duty, not a shekel tariff. Official 2026 Tabu cells stay the extract ₪88 and the warning note ₪188 — registrar tariffs, not an escrow invoice. Confirm a live file with a licensed Israeli real-estate lawyer.

What is a cheshbon ne’emanut?
lawyer's trust account — the usual receiving account for a non-resident purchase. Israel has no third-party escrow industry as standard. Chamber ethics rule 39 is the numbered duty: An advocate shall maintain a separate bank account for funds deposited with the advocate in trust. That account is separate trust / deposit bank account that Chamber ethics rule 39 requires an advocate to maintain for funds deposited in trust. (חשבון פקדון).
Is a warning note the same as escrow?
No. So long as the note has not been deleted, a conflicting transaction shall not be registered except with the entitled person's consent or by court order. That is Land Law, 5729-1969 s.127. Official 2026 register cell ₪188. A warning note is not completed ownership.
Does Sale Law create a staged escrow schedule?
No. The seller's duty to deliver the sold asset and the buyer's duty to pay its price are concurrent obligations that must be performed together. That is Sale Law, 5728-1968 s.23. The default is concurrent delivery and payment, not a US closing table. There is no official second-hand deposit percent on this disk.
How much is the official Tabu warning-note fee in 2026?
The official 2026 Land (Fees) Regulations cell to register a warning note is ₪188 (item 13(a)(1)). Deleting one is ₪127 (item 13(b)). The certified extract is ₪88. Those are registrar tariffs, not an escrow premium.
Is there title insurance on a Tel Aviv apartment?
No standard title-insurance market sits on this disk. The lawyer reads the Tabu extract, holds funds under ethics rule 39, and files the Land Law s.126 note. We invent no title-insurance tariff.
Will money into the trust account be reported?
A cross-border transfer of ₪1,000,000 or more is an automatic bank report under the 2001 Banking Corporations Order already published on the transferring-funds page. On the July 2026 hood-panel median ticket a non-resident cash-to-close is ₪2,894,200 — 2.9× that threshold. The report is threshold, not suspicion.
Does the 1974 7% ceiling replace escrow on a resale?
No. The 7% unsecured-payment ceiling and the listed securities bind that defined seller, not a typical second-hand private owner selling the home they live in. On the July 2026 citywide median asking ₪4,850,000 that 7% cell is ₪339,500 — labelled illustration, not a typical resale invoice.
