Cooling-Off and Cancelling an Israeli Apartment Purchase: No 14-Day Clock
A typical Tel Aviv apartment sale has no statutory 14-day cooling-off. The Consumer Protection Law’s 14-day cells are hawking, distance selling, and timeshare units. The 2010 cancellation schedule lists furniture and gyms, not an apartment. Cancellation of a formed sale is the 1970 remedies law for breach, not remorse. We invent no cancellation clock.

There is no 14-day cooling-off on a typical land sale
A typical privately owned Tel Aviv apartment sale has no statutory 14-day cooling-off. The Consumer Protection Law's numbered 14-day cells are hawking (s.14), distance selling (s.14C), and a timeshare unit (s.14A). The 2010 cancellation-regulations schedule lists furniture, gyms and similar consumer goods — it does not print an apartment. Cancellation of a formed sale contract is the 1970 remedies law for breach, not buyer's remorse, and that law prints a reasonable-time notice, not a day-count. English pages that paste a store-return clock onto a Tel Aviv file are mixing those cells. The July 2026 citywide median asking ₪4,850,000 (≈ $1,310,811 / €1,212,500 / £1,021,053; n = 1,037 tracked active listings) is the stake a cooling-off slogan would sit on. Implied size — that median divided by apartment-scale ₪/sqm (n = 987) — is 88 sqm (950 sqft). It is not a cancellation invoice. Tracked listings are not holdings. The Sale Law s.6 good-faith page already refused to invent a day-count. This page is the cancellation citation target.
The 14-day cells that do exist
An asset (נכס) is goods, land, rights, securities as defined in the Securities Law 5728-1968, and government bonds. A dealer (עוסק) is a person who sells an asset or gives a service in the course of business, including a manufacturer. A consumer (צרכן) is a person who buys an asset or receives a service from a dealer in the course of the dealer's business, for use that is mainly personal, household or family. Section 1 includes land inside 'asset'. That is not a 14-day cooling-off on every land sale. The 14-day cells sit in later sections with their own triggers. This carve-out is local to s.13א (renewal notices on a fixed-term deal). It is not a sentence that the whole Consumer Protection Law never mentions land. The numbered 14-day cells sit later: hawking — a dealer who arrives uninvited at the consumer's home, work, studies or their vicinity, or who initiated contact and then arrived there to close. (רוכלות) in s.14; distance selling — forming a sale or service contract after remote marketing, without the parties being present together. (מכר מרחוק) in s.14ג; and timeshare / holiday unit — a right of intermittent use for at least three years, two or more days each year. Not a typical Tabu apartment sale. (יחידת נופש) in s.14א. cancellation of a transaction — the Consumer Protection Law phrase for the listed 14-day cells, not a printed remorse clock on a typical land sale. (ביטול עסקה). A typical Sale Law land sale at a lawyer’s office is none of those three triggers. Confirm the paper you actually signed with a licensed Israeli lawyer.
| Cell | What the source prints | What it is not |
|---|---|---|
| Consumer Protection Law, 5741-1981 s.14 | In a hawking transaction the consumer may cancel the agreement — in a sale, from the day the agreement is made until fourteen days from delivery of the asset or from receipt of the particulars set in regulations under subsection (d), whichever is later; in a service, within fourteen days from the day the agreement is made or from receipt of those particulars, whichever is later. | A lawyer-led signing at the lawyer’s office. |
| Consumer Protection Law, 5741-1981 s.14ג | In a distance-selling transaction the consumer may cancel — for an asset, from the day the transaction is made until fourteen days from receipt of the asset or from receipt of the document that contains the subsection (b) particulars, whichever is later; for a service, within fourteen days from the day the transaction is made or from receipt of that document, whichever is later. | A printed day-count on every remote close. |
| Consumer Protection Law, 5741-1981 s.14א | In a transaction concerning purchase of a holiday unit the consumer may cancel the contract within fourteen days from the day both parties signed the contract, or from the day the consumer confirmed receipt of the disclosure form, whichever is later. Cancellation is by written notice to the dealer. | A typical privately owned Tabu flat. |
| Consumer Protection (Cancellation of a Transaction) Regulations, 5771-2010 r.2 | The schedule prints furniture; household and garden equipment; electrical and electronic appliances; goods in unopened original packaging; goods ordered and not yet supplied; water purifiers; clothing and footwear; hospitality, travel, holiday and leisure services; courses; cosmetics; long-term holiday deals; discount-club memberships; listed telecom and broadcast services; gym or spa memberships; dating-club memberships; lottery subscriptions; goods and services sold at a presentation event; a new vehicle bought from an importer; jewellery up to ₪3,000; and watches. | An apartment. The schedule does not print one. |
| Contracts (Remedies for Breach of Contract) Law, 5731-1970 ss.7–8 | The injured party may cancel the contract if the breach was fundamental. If the breach was not fundamental, the injured party may cancel after first giving the breaching party an extension to perform and the contract was not performed within a reasonable time after that extension, unless in the circumstances cancellation would be unjust. | Buyer's remorse or a 14-day store-return clock. |
Hawking is a dealer at the consumer’s place
Hawking is a dealer's offer to a consumer, or an offer by someone on the dealer's behalf, by a person who arrived uninvited at the consumer's home, military service, work, studies or their vicinity, and also at any place that is not a business of the dealer or of someone on the dealer's behalf — or an initiated approach by a dealer after which the dealer, or someone on the dealer's behalf, arrived at the consumer's place to form a transaction. That is the Act-text door, not a slogan. In a hawking transaction the consumer may cancel the agreement — in a sale, from the day the agreement is made until fourteen days from delivery of the asset or from receipt of the particulars set in regulations under subsection (d), whichever is later; in a service, within fourteen days from the day the agreement is made or from receipt of those particulars, whichever is later. A lawyer-led process that signs at the advocate’s office is not an uninvited arrival at the buyer’s home or work. A dealer who truly hawks a listed consumer good still sits in this cell — that is a fact about that visit. We invent no citywide share of Tel Aviv apartment files that were hawked. The zichron devarim page already said those instruments do not give a cooling-off period.
Distance selling is no joint presence
A distance-selling transaction is forming a transaction for the sale of an asset or the giving of a service when the formation follows remote marketing, without the parties to the transaction being present together. Remote marketing is a dealer's approach to a consumer by post, telephone, radio, television, any electronic communication, facsimile, catalogue or advertisement publication, or a similar means, in order to form a transaction without the parties being present together, except through one of those means. In a distance-selling transaction the consumer may cancel — for an asset, from the day the transaction is made until fourteen days from receipt of the asset or from receipt of the document that contains the subsection (b) particulars, whichever is later; for a service, within fourteen days from the day the transaction is made or from receipt of that document, whichever is later. Subsection (c) and s.14ג1(c) do not apply to a distance-selling transaction of perishable goods; hospitality, travel, holiday or leisure services if the cancellation date falls within seven non-rest days before the service is to be given; information as defined in the Computers Law 5755-1995; goods produced especially for the consumer following the transaction; or goods that can be recorded, copied or reproduced whose original packaging the consumer opened. Those exclusions do not name an apartment, and they do not invent one. A remote close still uses a yipui koach and still finishes at Tabu. Whether a specific marketing approach meets the no-joint-presence trigger is a fact about that approach. We invent no citywide rule that every power-of-attorney file inherits this 14-day cell.
A timeshare is a different right
A holiday unit is a right, proprietary or not, that gives its holder a right of intermittent use of a room or other dwelling, in Israel or abroad, for at least three years, for a period of two days or more during each year. In a transaction concerning purchase of a holiday unit the consumer may cancel the contract within fourteen days from the day both parties signed the contract, or from the day the consumer confirmed receipt of the disclosure form, whichever is later. Cancellation is by written notice to the dealer. That is timeshare / holiday unit — a right of intermittent use for at least three years, two or more days each year. Not a typical Tabu apartment sale. (יחידת נופש), not the privately owned apartment the July 2026 asking panel is tracking. Official 2026 Tabu cells on a land file stay the certified extract ₪88 and the warning-note register cell ₪188 (item 13(a)(1)) — registrar tariffs, not a timeshare disclosure form. Title still finishes at registration. We invent no official timeshare share of Tel Aviv stock.
The 2010 schedule does not print an apartment
Consumer Protection (Cancellation of a Transaction) Regulations, 5771-2010 (Kovetz HaTakanot 5771, 16; signed 2010-08-23) regulation 2 is the store-return list English pages quote as “14 days in Israel.” A consumer may cancel an agreement under paragraphs (1) to (7), provided that cancellation of a goods purchase is on condition the consumer returns the goods to the dealer and the goods were not damaged and the purchasing consumer did not use them. The schedule prints furniture; household and garden equipment; electrical and electronic appliances; goods in unopened original packaging; goods ordered and not yet supplied; water purifiers; clothing and footwear; hospitality, travel, holiday and leisure services; courses; cosmetics; long-term holiday deals; discount-club memberships; listed telecom and broadcast services; gym or spa memberships; dating-club memberships; lottery subscriptions; goods and services sold at a presentation event; a new vehicle bought from an importer; jewellery up to ₪3,000; and watches. That schedule does not print a dwelling, a Tabu right, or a Sale Law land sale. A furniture invoice and a Florentin flat are different cells. On the July 2026 citywide median asking ₪4,850,000 the 1974 builder-seller 7% ceiling — a different statute — is ₪339,500 (≈ $91,757 / €84,875 / £71,474) if that seller definition is met. It is labelled illustration, not a cancellation invoice.
Cancellation of a formed sale is breach, not remorse
Contracts (Remedies for Breach of Contract) Law, 5731-1970 s.6 defines a fundamental breach. For this sign, a fundamental breach is a breach about which it may be assumed that a reasonable person would not have entered that contract had they foreseen the breach and its results, or a breach the contract agreed would be treated as fundamental. A sweeping term that makes breaches fundamental without distinguishing among them has no effect unless it was reasonable when the contract was made. The injured party may cancel the contract if the breach was fundamental. If the breach was not fundamental, the injured party may cancel after first giving the breaching party an extension to perform and the contract was not performed within a reasonable time after that extension, unless in the circumstances cancellation would be unjust. Cancellation of the contract is by the injured party's notice to the breaching party within a reasonable time after the injured party learned of the breach. Where the injured party first gave an extension to perform — within a reasonable time after that extension ended. That notice cell prints “a reasonable time,” not fourteen days. Sale Law s.6 is still the performance duty on the formed sale — not this cancellation hook. Sale Law s.36 is a Mejelle repeal line. It is not a cooling-off clock and not a buyer's-remorse cell. We do not republish the 1970 amount tables. Confirm a live breach file with a licensed Israeli real-estate lawyer.
A signed memo can already bind
Land Law s.8 already requires writing for a land undertaking. A zichron devarim that is definite and intended can bind before the formal sale contract. Those instruments do not give a cooling-off period. Land Law s.7 still finishes the sale only at registration. So long as a warning note stands, a conflicting later deal shall not be registered except with the entitled person’s consent or by court order. Official 2026 register cell ₪188. Our tracked days-on-market median is 33 days from first publication to detected removal (p25–p75 16–42; n = 94; 59.1% dated coverage). That metric is time-on-listing. It is not a cooling-off clock.
What numbers stay unpublished
A statutory 14-day cooling-off on a typical land sale — A typical privately owned Tel Aviv apartment sale has no statutory 14-day cooling-off. A printed cancellation day-count on the 1970 remedies law — s.8 says a reasonable time. The 1970 amount tables — this file does not republish them. A citywide cancel share or typical liquidated-damages percent — no panel field. Named court cases that fill in “reasonable time” on a Tel Aviv file. Official 2026 Tabu cells stay the extract ₪88 and the warning note ₪188 — registrar tariffs, not a cooling-off penalty. The cluster map is the foreign-buyer guide.
Frequently asked questions
Is there a 14-day cooling-off on an Israeli apartment purchase?
Not on a typical privately owned sale. This is not legal advice.
Does the Consumer Protection Law never apply to land?
No. An asset (נכס) is goods, land, rights, securities as defined in the Securities Law 5728-1968, and government bonds. This carve-out is local to s.13א (renewal notices on a fixed-term deal). It is not a sentence that the whole Consumer Protection Law never mentions land.
What is hawking (rokhelut)?
hawking — a dealer who arrives uninvited at the consumer's home, work, studies or their vicinity, or who initiated contact and then arrived there to close. That is the Consumer Protection Law, 5741-1981 definition that opens the s.14 14-day cell. A lawyer-led signing at the lawyer's office is not that arrival.
Is a remote close from abroad a distance sale I can cancel in 14 days?
A distance-selling transaction is forming a transaction for the sale of an asset or the giving of a service when the formation follows remote marketing, without the parties to the transaction being present together. Whether a specific approach meets that trigger is a fact about that approach. We invent no citywide rule that every 14-day cell attaches to a power-of-attorney close.
Does Sale Law section 6 let me cancel for bad faith?
An obligation arising from a sale contract must be performed in an accepted manner and in good faith; the same applies to the use of a right arising from the contract. That is a performance duty. Sale Law s.6 is the sale-specific restatement of this general contracts cell. They are not three different duties on one invoice. It is not a cooling-off clock.
How do I cancel a formed sale contract?
The injured party may cancel the contract if the breach was fundamental. If the breach was not fundamental, the injured party may cancel after first giving the breaching party an extension to perform and the contract was not performed within a reasonable time after that extension, unless in the circumstances cancellation would be unjust. Cancellation of the contract is by the injured party's notice to the breaching party within a reasonable time after the injured party learned of the breach. Where the injured party first gave an extension to perform — within a reasonable time after that extension ended. That is breach, not remorse. We do not republish the 1970 amount tables.
Does a zichron devarim have a cooling-off period?
The statutes that make a written undertaking do not print one. A memo that is definite and intended can already bind. Route every preliminary paper through a licensed Israeli lawyer.
How much is the official cancellation penalty in shekels?
There is none on this disk for a typical land sale. The numbered cells next to it are the official 2026 warning-note ₪188 and, for a defined builder-seller, the 1974 7% unsecured-take ceiling — different statutes.
